MUNICIPAL ORDINANCE NO. 30

AN ORDINANCE DECLARING THE AMBURAYAN RIVER AND ALL ITS TRIBUTARIES AS PROTECTED RIVER BASIN AND IMPOSING PENALTY FOR THE VIOLATION THEREOF, AND FOR OTHER PURPOSES
Explanatory Note
“Whereas, this Municipality is blessed with a natural gift which is the Amburayan River and being the major provider of water this moment and to future generations to come. It has been viewed that measures appropriate for her conservation is necessary and shall therefore lay down the policies that could easily be inculcated to all inhabitants hereof for easy execution and for a continuous clean river;
Whereas, the Amburayan River is classified as Class B by the Department of Environment and Natural Resources which refers to Recreational Water Class l for bathing, swimming, skin diving, fishing and for tourism purposes and others;
NOW, THEREFORE, on motion duly seconded,
BE IT ORDAINED BY THE MUNICIPAL COUNCIL IN SESSION ASSEMBLED THAT:
SECTION 1. Definition of terms when used in this Ordinance.
SECTION 2. The Amburayan River and all its tributaries are hereby declared as protected river basin.
SECTION 3. It shall be unlawful for any industrial establishments, business, commercial and agricultural firms, persons, political subdivisions, government owned or controlled corporations and other similar entities and instrumentalities to dump or throw garbage or to dispose of any kind of wastes into the river or any of its tributaries.
If the violator is a corporation, firm or corporate entities, business establishments, the maximum shall be imposed upon he president, manager, director or persons responsible for its operation.
SECTION 4. The water classification of Amburayan River as Class B by the DENR, shall be maintained, enhanced, protected and shall be free from all domestic, industrial, agricultural and free from pollution.
SECTION 5. It shall be the duty of the members of the Environmental Task Force as provided under section 4 of the Municipal Ordinance No. 15-Series of 1996 to assist in the implementation of this ordinance.
SECTION 6. All other technical requirements and appropriate guidelines so far as the Department of Environment and Natural Resources is concerned shall be observed. Non-government Organizations offering their services are also recognized.
SECTION 7. PENALTIES – Anyone found violating this Ordinance shall be penalized as follows:
1st Offence – A fine of one thousand pesos (P/1,000.00)
2nd Offence – A fine of one thousand five hundred pesos (P/1,500.00)
3rd Offence – A fine of two thousand five hundred pesos (P/2,500.00) or imprisonment of six (6) months or both at the discretion of the court.
SECTION 8. REPEALING CLAUSE – All Ordinances, Resolutions and Local Executive Orders inconsistent with the provision of this Ordinance are hereby repealed accordingly.
SECTION 9. EFFECTIVITY – This Ordinance shall take effect upon approval and in accordance with the provisions of the Local Government Code of 1991.

- Amburayan River - Shall mean where the entire tributaries/major running waters particularly along Kapangan area of coverage. The Amburayan River is classified as Class B-Upper Reach.
- Tributaries – Shall refer to Sacboroy, Cotocot, Bolinsak, Cadtay, Gawa, Toplac, Cabilisan, Song-e, Bakna, and all other creeks converging at the Amburayan River.
- Beneficial Use – The Amburayan River is classified as Recreation Water Class 1. It shall be used for primary contact recreation such as bathing, swimming, skin diving, those designated for tourism and for economic use or source of food and livelihood.
